What is a whiplash injury?
Whiplash is a relatively common injury that occurs to a person's neck after a car accident, in most cases, after the rear-end car collision, front-end collision, or a side-impact collision. The whiplash can also be the result of sports accidents and slip and fall. You can get a whiplash injury even after falling off a bike.
Whiplash Injury: When an Uber driver is involved in an accident
If you are an Uber driver and another vehicle hit you from the back, or if an Uber car rear-ended your vehicle, do the same as in any other car collision - exchange your information with another driver and get a police report. If somebody gets injured, call the ambulance, take many photos, and gather eyewitness information.
Then hire an attorney who handled Uber accident lawsuits in the past. Uber claims have a different process than the regular car accident claims, mostly because the insurance coverage depends on whether the passenger was in an Uber car / the Uber driver was on the way to pick up a passenger - or it was a personal trip of the Uber driver.
You can sue for damages after the whiplash injury regardless. Just keep in mind that the driver's insurance most likely has minimum coverage while Uber carries a commercial insurance policy.
Who is liable?
Under Nevada law, the party who is at fault for causing an accident is financially liable for the victims' damages. It includes whiplash injuries.
Car accidents
In case of car accidents, there may be more than one defendant, including:
• The car driver,
• The car owner,
• The car manufacturer(s),
• The car parts manufacturer(s),
• The car repair shop,
• The road construction company.
Furthermore, sometimes more than one motor vehicle contributes to the accident. It could have been two other cars, a bus, truck, or motorcycle. In Nevada, you can file a claim against some or multiple defendants responsible for the crash.
Sports accidents
In sports accidents, liable parties for whiplash injuries could include the sport's league, coaches, trainers, or sport's stadium.
Other types of accidents
In some rare cases, an accident that caused a whiplash injury is just an accident. There is nobody to sue.
How long does it take to settle a whiplash claim?
Usually, it takes between 3 months and 1 year to settle a whiplash injury claim in Nevada. It may take longer in some complex cases with more than one victim and more than one negligent party.
How do you prove a whiplash injury?
The diagnosis of a whiplash injury often requires a magnetic resonance imaging (MRI) test.
In some cases, even an MRI is not enough. The whiplash may not show up on an x-ray or MRI, and the whiplash symptoms must be thoroughly documented and treated by medical professionals.
Symptoms of whiplash injury
While only a medical doctor can diagnose a whiplash injury, the known most common whiplash symptoms include:
• Neck, pain, and stiffness,
• Pain with neck movement,
• Loss of range of motion in the neck,
• Headaches, most often starting at the base of the skull,
• Tenderness or painin the shoulder, upper back, or arms.
Whiplash treatment
Simple therapies like hot and cold packs and pain medication can treat some whiplash injuries. If pain persists, treatment can include physical therapy, injection therapy, and even surgical intervention, so it is best to seek a medical professional after the accident immediately.
Can whiplash symptoms be delayed?
Yes. The whiplash symptoms are not always experienced right away and may take hours to present, often worsening in the days following an accident.
Whiplash recovery
The time it takes to heal after the whiplash injury varies significantly from person to person. It may take six weeks, or, in some cases, it may take three years.
What is the average whiplash injury settlement in Nevada?
There is no such thing as an average whiplash injury compensation.
The whiplash injury settlement includes reimbursement for past medical bills (in some cases for future medical bills, especially when long-term care is needed), lost wages, property damages, and pain and suffering. In many cases, the settlement amount is undisclosed.
Can whiplash come back years later?
If whiplash injury is left untreated, the effects (chronic neck pain or stiffness) may come years later. Some people feel the whiplash symptoms for 10 years after the accident.
Time limitations in Nevada
Under Nevada law, you have two (2) years from the crash date to file a lawsuit. It includes whiplash injuries. There are some exceptions. If you have any questions, call us at 702-432-1000 and ask to speak with our attorney for whiplash injury.
If you are partially at fault
In Nevada, if you are less than 51% responsible for the accident, you are still entitled to a settlement for the whiplash injury under the comparative fault law.
Do whiplash claims get rejected?
Occasionally, yes. If the insurance company devalues the injury, they may reject a whiplash injury claim. The best way to avoid this situation is to hire an experienced attorney who will submit an insurance claim on your behalf. Attorneys know how to correctly prepare a demand pocket and negotiate a fair settlement.
Can you re-open an old whiplash injury case?
Yes, but many restrictions apply to re-opening an old whiplash injury case.
You can re-open a previously settled case if a) they signed a release without an attorney and b) within 60 days of the accident. For more information, call our office.
How do whiplash injury attorneys get paid?
We work on a contingency basis, which means that you don't have to pay us until we settle your case or win at trial.
