Who is liable?

Is there a cap on a claim for sports injuries?
Yes, in some cases, there is a cap.
Because state sovereignty laws protect public schools and universities, there would be caps on damages. However, these rules don't apply to private schools, gyms, or universities. The settlements from private schools, colleges, gyms, and private leagues don't have any caps.
What makes the injury liability claim for the minor different?
Three (3) things make a sports injuries claim for the minor very different from the adult.
- A minor (under 18) cannot file a lawsuit. The minor's parent, both parents, or a guardian must file a lawsuit on behalf of a child.
- A Blocked Trust Account with a bank must be created to deposit the settlement money for the minor to receive when the minor turns 18.
- The law doesn't allow the child to sign for themselves until they become adults. Through a Minor's Compromise, a judge permits a parent to sign documents to receive money on behalf of a child.
In some cases, the lawyer must establish the amount of long-term care (aka Life Care Plan) that may be necessary to take care of the child's injury.
How to establish the amount of long-term care?
Calculating future medical expenses in sports injuries cases can be challenging, but still, attorneys do it all the time. The expert witnesses and even economists get involved in helping to calculate the medical cost of future medical care. The medical doctor may be able to determine how much treatment the child will need in the future. A physical therapist might indicate the length of time your child will need to work on injuries. An economist can help calculate the dollar's future value to pay for future treatment.
