Who is liable?

In Nevada, the negligent driver (or their insurance carrier) is financially responsible for injuries and property damages caused by car accidents. Liability when the Uber driver is renting a car

When an Uber driver borrows a vehicle from the rental company, they must still carry personal car insurance with the set-state minimum accident coverage. This liability coverage works the same way as in any other car accident - all liability claims are filed against the driver's car insurance. When the amount of claim exceeds the driver's insurance maximum limit and the driver was "on the job" during the accident (had passenger in a car or was on the way to pick up a passenger), the liability falls into the app-based ride-hailing company that hired that independent contractor and Uber becomes financially liable for an accident.

Note: The driver must rent the car from the approved by Uber rental company. Also, all claims are subject to the insurance policy deductible.

Liability when the Uber driver borrowed a car

When the vehicle belongs to a friend, family member, or a driver's parents, the driver must be attached to their car insurance. If an Uber driver caused an accident, the victim (or their attorney) files the liability claims against the driver's car insurance specified in the Uber job application.

The liability claims that exceed the driver's insurance policy limits are filed against Uber's commercial insurance.

When the driver of another vehicle causes an accident, the responsibility falls to the driver who caused the accident.
