A first-party claim is a claim that you file against your insurance. The third-party application is when you submit a liability claim against the at-fault driver insurance.

If you are the at-fault driver, and your vehicle insurance is Progressive, the situation is very straightforward - you file a first-party Progressive auto insurance claim. But the situation is not so simple if you are the victim of a motor vehicle accident or if your accident involved many vehicles and several victims. You need to submit a third-party claim to the at-fault party or multiple parties to get compensation for medical bills and other damages. Usually, the attorney files these complex insurance claims on behalf of the victim(s).

If you or your passengers suffered an injury in a car accident caused by another driver's negligence, you may:

  1. File a third-party complaint against the at-fault driver insurance.
  2. Sue the at-fault driver for damages without first exhausting your insurance coverage.
