About GEICO
GEICO (The Government Employees Insurance Company) was founded in 1936 as an automobile insurance provider to federal government employees and their families. By 1996, GEICO became a wholly-owned subsidiary company of the conglomerate Berkshire Hathaway. Today, GEICO is considered the fastest-growing major auto insurer in the country and offers automobile insurance throughout the United States to everyone, not only government employees.
If you got injured in a motor vehicle accident and the at-fault driver has GEICO insurance, you probably have many questions about what to expect. In this article, we answered the most common questions our clients ask.
Liability after the motor vehicle accident in Las Vegas
In Nevada, the at-fault party (or their insurance carrier) is financially responsible for all damages caused by accident - medical bills, property damages, pain and suffering, and lost wages.
If you were partially at fault
Nevada is a modified comparative negligence state. It means the plaintiff can collect compensation from all other at-fault parties if they were less than 51% responsible for the accident. It also means you may still be compensated for your medical bills and other losses if you are partially responsible for the crash.
Does GEICO insurance cover DUI accidents?
The question we are hearing a lot is, "Does GEICO insurance cover DUI accidents?"
Yes, GEICO does provide coverage for damages resulting from accidents caused by DUI incidents or criminal activities.
How long does it take for GEICO to settle?
Each case is different. It depends on the case's complexity and could be from six weeks to seven years. Typically, lawsuits with multiple claimants or multiple vehicles take longer to settle.
Is Geico good at paying claims?
Like most insurance companies, GEICO is in the business of making money, not losing money. When paying claims, GEICO is NOT making money, quite the opposite. What does it mean to the claimant? You have to fight to get a full and fair settlement. The policy maximum limit is essential in the amount of accident compensation the client can expect.
What is the average GEICO payout for a car accident?
It all depends on the case. The payout or settlement amount is calculated based on your medical bills (past, present, and future), lost wages, pain and suffering, and other damages.
How do you calculate the pain and suffering part of the claim?
Most insurances use a computer system to calculate the pain and suffering amount. On the other hand, attorneys multiply the dollar amount of medical bills by the number between three and five, and in some very complex cases by seven, to calculate the pain and suffering amount of accident compensation.
An experienced and skilled lawyer for insurance claims can challenge and negotiate the pain and suffering part of the settlement. No two cases are alike, and if you want to know what amount to ask for pain and suffering after your car accident, call our office at 702-432-1000.
Is there a cap on pain and suffering?
No. Las Vegas and Nevada don't have a cap on the pain and suffering part of the motor vehicle accident compensation.
GEICO accident settlement offer: What to know
Each case is different. Hardly anyone accepts the first settlement offer. With GEICO, the first offer is usually low, sometimes less than the dollar amount of medical bills. The second offer is much better. The negotiations between the claimant (or the attorney representing the claimant) and the insurance company can go back and forth several times until all parties reach an agreement.
Jury Trials
While attorneys usually settle car accident cases, some go to trial, and the jury decides the full and fair amount of accident compensation.
Be prepared that the settlements the jury awards are not necessarily better than the compensation offered during the claim negotiation. Las Vegas had several trials where the jury awarded accident compensation much less than they were willing to pay during the pre-trial negotiations.
Time limits to bring a case (statute of limitations)
Under Nevada law, you have two (2) years from the date of an accident to file a personal injury claim. Read NRS 11.250 to know the details of Nevada's statute of limitations laws.
