About USAA insurance
USAA insurance serves military members and their families. Not everyone can buy USAA insurance. You have to be currently serving in the U.S. Air Force, Army, Coast Guard, Marines, Navy, National Guard, and Reserves. Veterans, family members, cadets, and midshipmen are also eligible to buy motor vehicle insurance from the USAA.
Our law firm routinely processes car accident claims with USAA. In our experience, USAA is one of the better insurance companies. Their payout is usually higher than other insurances, and their claims submission process is much more manageable.
Liability after the motor vehicle accident in Las Vegas
In Nevada, the at-fault party is financially responsible for medical bills and other damages. Even if you are partially responsible for the crash, you may still get compensated for your medical bills and other losses under comparative negligence law. Call our office at 702-432-1000 for more information.
USAA settlement calculator
The USAA, like many other insurance companies, uses the software Colossus to calculate personal injury settlements. A certain dollar amount is pre-assigned to compensate for every small or big medical treatment, future medical bills, and other damages.
Still, a skilled attorney may challenge the offered accident settlement.
Negotiating a settlement with USAA in Las Vegas
Each case is different. The compensation amount depends on the past and current medical bills and how much medical care you may need in the future. The lost wages, pain and suffering, and property damages also are included in a settlement amount. Today, many insurance companies (USAA is one of them) don't publish the accident compensation amount.
What is the USAA claims time limit?
Under Nevada law, you have two (2) years from the date of an accident to file a personal injury claim. There are some exceptions to this rule. Read NRS 11.250 if you want to know the details of Nevada's statute of limitations laws.
Can I re-open an old claim with USAA in Las Vegas, Nevada?
Usually not. After you cashed the settlement check from the insurance company or signed and turned in the release, you can't always re-open the case, even if you require more medical treatment.
However, starting from October 1, 2019, the personal injury victim can take back a prior agreement with the insurance company and re-open the case under certain conditions: a) if you signed the release within 30 days of the accident, without the aid of an attorney, and b) within 60 days of the accident, the victim, or their attorney, tell the insurance company, in writing, that they want to void the release, and they return the money within 10 days of their writing. If you have any questions, call our office.
How long does it take to settle a case with USAA in Nevada?
It depends on too many variables. Cases involving multiple cars or multiple victims take longer to settle. When the claimant accepts the first or second offer, the lawsuits settle relatively fast. Call us, so we would understand your case better and provide recommendations that are right for you.
Insurance deductible
The USAA will automatically subtract the amount of deductible from your settlement check.
How long does it take to get a settlement check from USAA?
In our experience, it takes 4 - 6 weeks after all parties agree on a settlement amount.
USAA MedPay claims in Nevada
The USAA allows the insurer to purchase optional MedPay (Medical Expense Payments) coverage. The MedPay insurance reimburses medical bills (or your medical bills up to a certain dollar amount) for you and your passengers. MedPay will also cover your co-pays. In essence, MedPay is supplemental health insurance.
What makes USAA unique is that the amount of USAA MedPay insurance coverage, sometimes between $50,000 and $100,000, is much higher than most insurance companies. However, be prepared that your MedPay claim will be scrutinized and challenged by USAA insurance adjusters.
First-Party claim vs. Third-Party claim: What is the difference?
A first-party claim is a claim that you file against your insurance. The third-party claim is when you submit a liability claim against the at-fault driver's insurance.
Our office handles dozens of first-party claims and third-party claims against USAA.
