About USAA insurance
USAA insurance serves military members and their families. Not everyone can buy USAA insurance. You must currently serve in the U.S. Air Force, Army, Coast Guard, Marine Corps, Navy, National Guard, or Reserves. Veterans, family members, cadets, and midshipmen are also eligible to buy motor vehicle insurance from the USAA.
Our law firm routinely handles car accident claims involving USAA. In our experience, USAA is one of the better insurance companies. Their payouts are often higher than those of many other insurance companies, and their claims process is generally more manageable.
Liability after the motor vehicle accident in Las Vegas
In Nevada, the at-fault party is financially responsible for medical bills and other damages. Even if you are partially responsible for the crash, you may still get compensated for your medical bills and other losses under comparative negligence law. What factors affect personal injury settlement amounts?
Insurance settlements are not arbitrary numbers. Adjusters evaluate the value of a claim based on documented damages, including medical expenses (past, present, and future), lost income, and the long-term impact of the injury.
Medical treatment is often the largest factor in determining settlement value. Claims involving surgery, rehabilitation, or long-term care typically result in higher settlements because they include future medical costs.
Many websites list "average insurance settlements," but these numbers are rarely meaningful. Settlement values depend on the specific damages in each case. For questions about your claim, contact our office.
How long does it take to settle a case with USAA in Nevada?
Many people ask when they will receive money from a USAA claim. The timeline often depends on the injured person's recovery and when doctors can estimate the cost of future medical treatment.
Cases involving multiple vehicles or victims may take longer.
When the claimant accepts the first or second offer, the case settles relatively quickly. Call our office to discuss your case and possible options.
How long does it take to get a settlement check from USAA?
In many cases, it takes about 4–6 weeks to receive a settlement check after all parties agree on the settlement amount and the necessary paperwork is completed.
Are USAA settlement amounts public?
People often ask what settlements were paid in similar cases in the past. The answer is not straightforward. Today, many insurance companies, including USAA, do not publish accident compensation amounts.
Can I reopen an old claim with USAA in Las Vegas, Nevada?
Usually not. After you cash the settlement check from the insurance company or sign and turn in the release, you generally cannot reopen the case, even if you require more medical treatment.
However, starting from October 1, 2019, the personal injury victim can take back a prior agreement with the insurance company and reopen the case under certain conditions: a) if you signed the release within 30 days of the accident, without the aid of an attorney, and b) within 60 days of the accident, the victim or their attorney notifies the insurance company, in writing, that they want to void the release, and they return the money within 10 days of their writing. If you have any questions, call our office.
How deductibles affect your USAA settlement
USAA will usually subtract the deductible from the settlement amount before issuing the payment.
What is the USAA claims time limit?
Under Nevada law, you have two (2) years from the date of an accident to file a personal injury claim. There are some exceptions to this rule. Read NRS 11.250 if you want to know the details of Nevada's statute of limitations laws.
USAA MedPay claims in Nevada
USAA allows policyholders to purchase optional MedPay (Medical Expense Payments) coverage. MedPay reimburses medical bills up to a certain dollar amount for you and your passengers. MedPay will also cover your co-pays. In essence, MedPay is supplemental health insurance.
What makes USAA unique is that its USAA MedPay insurance coverage, sometimes between $50,000 and $100,000, is much higher than most insurance companies offer. However, be prepared that your MedPay claim will be scrutinized and challenged by USAA insurance adjusters.
First-Party claim vs. Third-Party claim: What is the difference?
A first-party claim is filed with your own insurance company. A third-party claim is filed against the at-fault driver's insurance company.
Our office handles dozens of first-party claims and third-party claims against USAA.
