About State Farm Car Insurance
State Farm underwrites about 20% of all motor vehicle insurances offered in Nevada, more than Geico, Progressive, and Allstate. Almost every week, somebody comes to our office asking for help with State Farm Insurance claims. We compiled a list of the popular questions people ask our attorney for insurance claims.
Should I give a recorded statement to the State Farm Insurance?
A person should only give a recorded statement for bodily injury if directed by their attorney or if their insurance requires it. A person must cooperate with their insurance company but not with an adverse insurance company. In other words, if your insurance is State Farm, you must talk to them.
What if both the at-fault driver and the victim have State Farm insurance? Does it help my claim or hurt it?
It depends on the facts. Typically, the property damage aspect of the claim can resolve itself faster. On the other hand, if a person has supplemental injury insurance with State Farm, that person should still consider hiring an attorney to pursue the bodily injury claim. If you need more information, call us at 702-432-1000.
The State Farm assigned a team of adjusters to my claim. Is it good news? Does it help the insurance liability claim?
No, it does not help. Claims assigned to the team do not get the same attention as claims assigned to one specific person. When the adjuster's group handles your injury reimbursement claim in Las Vegas and Nevada, expect the worst customer service and a valuation based on a computer and with little wiggle room from the adjusters. If the team of adjusters handles your claims, consider hiring an attorney.
How much money can I sue State Farm for pain and suffering?
In Nevada, as much as you want for most personal injury cases. The number of pain and suffering should have some connection to the dollar amount of your medical expenses (past, current, and future in complex injury cases) and the dollar amount of your lost wages due to the inability to work and provide for yourself and your family. In addition, every insurance policy had a policy maximum limit per accident. The insurance will pay no more than the maximum specified in a policy.
Can I write my demand letter?
Yes, but a demand letter from a law office will carry more authority because a law firm is better positioned to fight the case in court.
A demand written by a victim is likely to be devalued.
Is it worth getting an attorney for an insurance claim?
When a person is injured, it is worth getting an attorney. Head injuries, for instance, are significantly undervalued by insurance companies. You need to hire an attorney if you suffer serious injuries (e.g., neck or spine injuries), don't have health insurance, seek reimbursement for your lost wages, and pain and suffering.
However, if only the vehicle is damaged, but nobody was injured, you can file a claim yourself. If the insurance company refuses to pay, ask the Nevada Department of Insurance for help.
Comparative fault: What you need to know
Nevada is a modified comparative negligence state. It means the plaintiff can collect compensation from all other at-fault parties if they were less than 51% responsible for the accident. It also means you may still be compensated for your medical bills and other losses if you are partially responsible for the crash. It will be a reduced compensation, but there will be compensation.
Time limits to file a claim
Under Nevada law, you have two (2) years from the date of an accident to file a personal injury claim. There are some exceptions to this rule. Questions? Call us at 702-432-1000.
