Who are the Postmates couriers

Postmates couriers are independent contractors who use a Postmates technology platform to deliver anything and anywhere in Las Vegas. The goods (groceries, restaurant deliveries, paper supplies, or anything else) could be brought by motor vehicles, scooters, and bicycles, or even on foot.

How Postmates insurance works

Postmates drivers in Nevada must maintain their own up-to-date personal motor vehicle insurance and comply with all the insurance minimums needed by law. In an auto accident, the driver submits a claim directly with their auto insurance, which covers vehicle damages and bodily injuries. It is also subject to the deductible specified in a driver's car insurance policy.

Postmates provides excess auto insurance for their couriers if the personal auto insurance is not enough to cover damages they cause to OTHER parties (including third-party property damages and bodily injury).

It makes no difference how the driver delivers goods for excess auto insurance.

The maximum third-party insurance coverage for Postmates is $1 million per accident. It covers the bodily injuries and property damages and subjects to the deductible.

Settlements after the accident

If you are a Postmates driver, in the event of an accident, your reimbursement for your medical bills and other damages (e.g., vehicle damages) will come from your car insurance and subject to deductible specified in your insurance policy.

If you are the OTHER party who got in an accident where the Postmates driver was at-fault and at the time of a crash the Postmates driver was delivering packages ("was on the job"), then your settlement will come from:

  1. Postmates driver's insurance,
  2. Postmates commercial liability insurance,
  3. In multi-vehicle accidents, the compensation may come from the other drivers' car insurance.

Expected compensations

Your accident settlement after the Postmates accident depends on:

  • Who is at fault?
  • How severe the injuries are.
  • How much medical treatment is required.

Each accident is different. If you got injured in a Postmates accident and want to know what to expect, call our office at 702-432-1000 and ask to speak with our personal injury attorney.

If you are partially at fault

Nevada uses a modified negligence rule, which applies to all accidents where the victim is partly responsible for the collision. Typically, it means that if you were less than 51 percent liable for an accident where you got injured, you still could sue another party for damages.

Do I need an attorney?

If you are a driver of a Postmates vehicle and your car got damaged in an accident, you can submit the claim yourself to your car insurance carrier.

However, if you were injured, even if you were the driver in a Postmates vehicle, it is better if an attorney files a claim on your behalf. This way, you can get fair compensation for your medical bills, lost wages, property damages, and pain and suffering.

Who is liable?

Under Nevada law, a negligent driver (or their insurance carrier) is financially responsible for injuries caused in a car accident.

Accidents with multiple victims

Like most car accidents, when a Postmates accident involves numerous victims, each person files a separate accident liability claim against the Postmates driver and the Postmates commercial insurance.

Multiple vehicle accidents

It makes no difference for the amount of compensation you receive, whether there are numerous vehicles or just one vehicle involved in a Postmates car accident in Las Vegas, Nevada.

If you got hurt in an accident involving a Postmates driver, you should get compensation for all your medical bills, lost wages, damaged property, and pain and suffering.

Time limits to file a Postmates accident claim in Las Vegas

In Nevada, you typically have two (2) years from the incident date to file your claim. All Postmates accidents fall into this category. There are only very few exceptions to this rule. Call our office and ask to speak with a personal injury attorney if your accident happened more than two (2) years ago, and you want to know if an exception may apply to your case.

When out-of-state visitors involved in an accident

Our office handles car accident claims for out-of-state visitors all the time. Usually, the clients do not fly back to Las Vegas. We collect all medical records and track the progress of your Postmates accident case, from inception to settlement, in our Las Vegas office. When we settle your case, we mail the settlement checks to you. We will answer all your questions by email, phone, ZOOM, or Skype.

When foreigners get injured in an accident in Nevada

If the victim is a foreign national, the case may not be so simple. If you end up in a Las Vegas hospital and treated for injuries in the US, the settlement claim will be based on the US's hospital bills. Getting compensation for treatment in another country might be problematic, mainly because medical care costs in other countries can be very different from the US. There is no guarantee that it will be approved in the US, either.

We can help

Personal injury cases can be very challenging when dealing with app-based businesses like Postmates. The fact that the driver was delivering goods ("was on the job") or was using the vehicle for the personal trip determines the compensation maximum limits available for reimbursement. Furthermore, if more than one person is injured or multiple cars are involved in an accident, the lawsuit becomes even more complex. We are here to help.
