Who is liable?

What is the cause of an accident at school?

Slips and falls. Many child injuries occur in the classroom when backpacks are left in an aisle, cables to computers or TVs are not adequately secured, or water is spilled on a floor.

2. Document everything your child said, especially the date, time, and details of an accident. Was the schoolteacher present during the accident? If the accident at school happened outdoor, how was the weather? Were other children's parents or school employees present during the accident? Do public schools have immunity from lawsuits?

No, public schools don't have immunity from liability from accidents at school. NRS 41.031 explains the Waiver of Sovereign Immunity.

Public school accidents

If the school is part of the government school district, caps on damages limit the recovery.

For example, in school bus accident cases, if the Clark County government is operating the vehicle, there is usually a $100,000 cap on damages per bus accident.

Private school accidents

If the accident happened in a private school, the school owner's private insurance covers an accident, and the maximum policy limit could be very high. For example, if a private entity operates the school bus, it might have a commercial policy with a $1,000,000 insurance limit per accident.

There are no caps on damages for private colleges, private gyms, and private leagues.
