Why do slip and fall school accidents happen?
There could be many reasons for slip and fall school accidents. Below is only a partial list of events that could cause an accident:
- Clutter at the aisles (e.g., backpacks left on a school floor and caused someone to trip)
- Malfunctioning playground equipment
- Debris on school property
- Cables to school computers or TVs are not adequately secured
- Liquid spill in the school cafeteria
- Slippery flooring or stairs
- Unsanitary school conditions
- Bullying
Who is liable?
While there are many reasons for the trip, slip and fall school accidents, these accidents usually result from the school's negligence. If the school knew about hazardous conditions (e.g., faulty playground equipment) and did nothing about it, or if the school allowed children to play unsupervised when there should be a teacher on duty, the school was negligent and financially liable for all damages to the victim. It includes all medical bills (past, present, future) and other damages.
There are, however, a few exceptions. For example, if your child slipped, fell, and was injured on school property after school hours or the activity was not a school-organized event, you will likely have difficulty building a solid liability claim. For more information, call our office.

Private school vs. Public school accidents
If a slip and fall at school accident happen in a private school, you (or the attorney representing you) file a claim against the school's commercial general liability insurance.
However, if the accident happened in a public school (middle school, high school, or university), the liability claim is filed against the state government, and the rules are different. Moreover, there are caps on damages that the victim can collect for the accident in a public school. Currently, the cap is $100,000 per claim.

Time limits to file a claim
In Las Vegas and Nevada, you have two (2) years from the date of an accident to file a liability claim. It includes all slip and fall school accidents.
What settlement should I expect after a slip and fall school accident?
The compensation amount after the accident depends on the dollar amount of medical bills (past, present, future) and other damages. In cases when the accident happened in a private school, the maximum limit per accident claim of a school liability insurance plays an important role.
If the accident occurred in a public school, there would be caps on damages. Currently, the cap is $100,000 per claim.
If you want to know what compensation to expect in your case, you need to speak with an attorney. The attorney will review the circumstances of your slip and fall school accident and explain what to do next.
Do I need an attorney if I get hurt on school grounds?
Not necessarily. If you got a minor injury on school grounds (e.g., pulled muscle or a few scratches), you could file a complaint against the school yourself. However, in cases when your slip and fall school accident resulted in a severe injury and required expensive long-term medical treatment or your slip and fall accident aggravated the previous injury, hiring an attorney is highly recommended. Slip and fall accidents could be complicated. For cases with more than one injured accident victim or more than one party responsible for an accident, it is better if an experienced attorney files a liability claim on your behalf.
