About American Family Insurance

American Family Insurance, also known as AmFam, has a significant presence in Las Vegas and Nevada, offering car insurance to Nevadans and other insurance products.

Our law firm represented many clients with claim disputes with American Family Insurance.

Below is a list of common questions the clients who contacted us asked.

How long do you have to file a claim with American Family Insurance?

The statute of limitations for personal injury expires after two (2) years. If the at-fault party carries American Family insurance, you have two years from the date of an accident to file a claim. There are some exceptions to this rule. Call us if you need more information.

Who pays for damage in a car accident?

In Nevada, the at-fault party (or their insurance) is responsible for all damages after the accident. In cases when you are partially at fault, you still are eligible for accident compensation, as long as you are less than 51% at fault.

How do you negotiate with a claims adjuster?

Settling an accident claim with an insurance company on your own is not simple and may result in only a partial settlement. If you suffer from bodily injury after the accident and require medical treatment, an experienced attorney should negotiate a claim on your behalf. Remember that the claims adjuster you talk to on the phone represents the insurance company's interests, not yours. The adjuster will use any wrong word or answer you say to reduce your settlement.

Which insurance company pays in an accident?

The at-fault driver insurance pays for an accident. If the at-fault driver is uninsured or underinsured, you may file a claim against your car insurance. All insurances have a set maximum dollar amount per accident and per person and will only pay up to the maximum policy limit. There are some exceptions to this policy. For more information, please call our office and ask to speak with an attorney for insurance claims.

What questions should I ask an insurance adjuster?

In cases when somebody was injured, we recommend not to talk to the insurance adjuster without an attorney being present. This is true about American Family Insurance but also for any other insurance company. When the insurance adjuster calls you, take their information (phone, name, address) and politely tell them that your lawyer will contact them.

How long does it take to get a settlement check from American Family Insurance?

It all depends on the complexity of the case. Attorneys settle some American Family Insurance claims within a few months, and some may take three years to resolve.

When multiple victims involved

Car accidents can be very complex and may include numerous victims and vehicles. Under Nevada law, the at-fault driver must compensate ALL victims who filed a claim.

What is a reasonable settlement for a car accident?

Your car accident settlement is calculated based on your medical bill (past, present, future), property damages, lost wages, and pain and suffering. Each accident claim is different and usually settled differently. If you want to know what compensation to expect in your case, call us at 702-432-1000 and ask to speak with our attorney for insurance claims. Consultations are free.

Can I re-open an old case with American Family Insurance?

Yes, but there are many restrictions to do it. The claimant could take back a prior agreement with American Family Insurance and re-open the case within 30 days of accepting a settlement - if they signed the release without a lawyer's aid. If you want to re-open your old claim, call our office and ask to speak with a lawyer for insurance claims.
