How Do I Know If My Criminal Record Is Sealed?

This question comes up a lot. Many clients ask us, "How do I know if my criminal record is sealed?"

We recommend obtaining another criminal history report from the police department at the end of the sealing process. The new criminal history report will show that "No Criminal History Was Found." This message on a criminal history report proves that the record seal was successful and the sealing process is complete.

The problem sometimes occurs when a third-party company runs a criminal history report within the next few days after the court approves your petition for a record sealing.

When a third-party company does a background check

Some employers go through separate third-party companies to do pre-employment screening (also called a background check or criminal background check), which includes a criminal history report of the job applicant. These third-party companies are separate entities, maintain their private database, and nobody knows which company your employer selects for your background check.

Occasionally, we see cases when these companies still show a criminal history even though the record seal is complete. It usually happens within the first week after the record seal process completion.

Nevada's record seal process does not have a way to notify third-party companies that they can no longer display your criminal record. However, the good part is that these third-party companies constantly update their records. Once your record seal is completed and your criminal record doesn't appear on a report displayed to the public, third-party companies will update their computer systems to mirror the public record.

The third-party background check dilemma: What to do

You can email the company's technical support team a copy of the Order to Seal Records if you find your criminal record information on a third-party website. They will delete your criminal record from their computer system.

Order to Seal Record

All arrests listed on the Order to Seal Records are deemed never to have occurred, and the person to whom the Order pertains can answer accordingly.

At the end of the record seal process, keep the following for your record:

  • The filed Order to Seal Records signed by a Judge and
  • An updated criminal history report. That report will state, "No Criminal History Was Found."
