What is a DoorDash service?
DoorDash is a food delivery service that connects customers with restaurants and independent food couriers, often called "Dashers."
DoorDash drivers are independent contractors who use a DoorDash technology platform. The Dashers bring ordered food to your location by cars, motorcycles, scooters, bikes, or even walking in some areas (e.g., the Las Vegas strip).
Liability in case of an accident
DoorDash drivers in Nevada must maintain liability car insurance, complying with the state-set minimums. In an auto accident, all damages sustained to Dasher's vehicle are the driver's responsibility. The accident victim should file a liability claim directly with a Dash delivery driver's auto insurance carrier. The same is true if the DoorDash driver is injured.
Excess auto insurance
DoorDash does provide excess auto insurance. However, this policy applies only to damages caused to other parties (i.e., third-party property damage and bodily injury) and only to accidents while on an active delivery.
Also, DoorDash's insurance applies in excess of the driver's primary personal automobile insurance only after exhausting the driver's auto insurance limit. At the time of writing, the maximum third-party insurance coverage for DoorDash was $1 million per accident, subject to a $50,000 deductible.
Who is liable?
In Nevada, a negligent driver (or their insurance carrier) is financially responsible for injuries and property damage caused by a motor vehicle accident.
Who is paying for medical bills?
If you are a DoorDash driver, your reimbursement for medical bills and vehicle damages will come from your car insurance.
If you are the OTHER party who got in an accident with a DoorDash vehicle and if a DoorDash driver was the at-fault and was delivering food during the accident (was "on a job"), then your settlement will come from:
- DoorDash driver's insurance
- DoorDash company commercial liability insurance
- A third-party insurance carrier(s), when multiple vehicles are involved in an accident
DoorDash: Food delivery robots
Food delivery robots have emerged as a promising innovation in food delivery services, and companies like DoorDash have been exploring their potential.
DoorDash developed its own food-delivery robot. In 2021, DoorDash received federal approval on two patents for small, compact self-driving delivery vehicles.
Food delivery robots run primarily on college campuses. UNLV in Reno is one of them.
Food delivery robots & accident liability
The food delivery robots are small, travel at pedestrian speed, and have sensors, cameras, navigation systems, and other technologies that enable them to navigate safely. They also can be controlled remotely and are usually used in small, closed spaces like college campuses.
Nevada doesn't have special rules for accidents involving self-driving vehicles.
Based on current regulations, the at-fault party is responsible for all damages in the event of an accident.
If the DoorDash self-driving robot is involved, the at-fault party can be a robot manufacturer, robot component manufacturer, software developer, Internet provider, and other parties involved in creating or operating the robot. The robot owner can also be liable for an accident.
Challenges/Issues with DoorDash accidents
Navigating the legal complexities surrounding gig economy workers, liability, and insurance can be challenging.
Here are some issues involved:
Determining liability: When multiple insurance policies are applied, establishing who is at fault in the accident can be complex.
Insurance coverage issues: Coordinating between DoorDash's insurance, Dasher's insurance, and any other relevant insurance policies can be challenging.
Identifying responsible parties: Sometimes, identifying the responsible Dasher or obtaining their insurance information might be difficult.
Expected compensation
Your settlement after the DoorDash accident depends on:
- How severe your injuries are
- How much medical treatment is needed
- Who is at fault
In personal injury law, a one-size-fits-all approach doesn't apply. Each case is different. If you were injured in a DoorDash accident and want to know what compensation to expect, call our office at 702-432-1000.
If you are partially at fault
Nevada uses a modified negligence rule for all accidents where the victim is partly responsible for the collision. What it means to you - if you were less than 51 percent liable for an accident when you got injured, you still can sue another party. All DoorDash accidents are in this category.
Accidents with multiple victims
Like most car accidents, when a DoorDash accident involves numerous victims, each person files a separate accident liability claim against the DoorDash driver and the DoorDash commercial insurance.
Multiple vehicle accidents
Whether there are numerous vehicles or just one vehicle involved in a DoorDash car accident makes no difference to the compensation you receive.
Your compensation is based on your medical bills and other damages.
Time limits to file a DoorDash accident claim in Las Vegas
Under Nevada law, typically, you have two (2) years from the incident date to file your claim. All DoorDash accidents fall into this category.
We can help
Personal injury cases are never simple when dealing with app-based businesses. Different accident coverage depends on whether the DoorDash driver was "on a job" (delivering food). As a result, multiple insurance companies get involved, and you need an attorney with experience handling cases when the driver is an independent contractor of the app-based business. Some accidents may also involve multiple victims and vehicles, complicating a claim.
We take all DoorDash accidents on a contingency basis, which means we don't ask for fees unless we recover damages for our clients.
We serve clients in Las Vegas, Summerlin, North Las Vegas, Henderson, and Nevada.
