There are 9 things you must know about bus accidents in Las Vegas or Nevada.
1. If the government operates the bus, there will be a cap on damages.
The settlement money comes from the bus company's business insurance. So, who operated the bus is very important. If the private company operates the bus (e.g., tour bus), they have commercial liability insurance, which usually provides one million coverage per accident. But if the accident happened in a bus operated by the government (e.g., city buses), the coverage has a cap. At the time of writing, this cap is $100,000 per accident.
Even if your medical bills exceed $100,000, the injury compensation will still be $100,000 or less.
2. Bus accidents often have multiple victims.
It is not unusual for a bus accident to have multiple victims.
Getting an accident injury compensation becomes more complex when many victims are involved. It also means that it may take longer for a case to settle because ALL claimants must be satisfied.
3. Each victim files a separate lawsuit.
In a multi-victim accident, each injured person files a separate lawsuit and demands reimbursement for their medical bills (past, present, future), lost wages, loss of future earnings, rehabilitation therapy, pain and suffering, PTSD effects, and other damages. The compensation the bus accident victim demands directly correlates to medical bills and other damages.
4. Each victim may have a different attorney.
Having many attorneys involved has its advantages and disadvantages.
The advantage is that the attorney represents you and only you and your interests.
The disadvantage is that different attorneys may have different opinions on handling the same bus accident, which can slow down the process of getting accident compensation. It also means even if you are ready to submit your liability claim, other victims' claims may not be ready (e.g., the injured person is waiting for surgery or the estimates for future treatment costs), and you have to wait for other claimants.
It is not unusual for several bus accident victims to hire one (1) attorney to handle their claims.
Overall, the multi-victim bus accident cases take additional time to settle and may drag on for years.
5. Having multiple victims affects your settlement.
Simple bus accident claims quickly become very complex when many people are involved. The insurance company will divide the amount of money available for the bus accident settlement among ALL victims who submitted a claim.
So, when a private bus is in an accident, the private company may have one million per accident coverage, which is the amount divided among multiple claims. When the government bus gets in an accident, and there is a cap on damages, that amount available to ALL claimants is only $100,000.
If you need more information or want to know what to expect in your situation, call our office at 702-432-1000 and ask to speak with a bus accident attorney.
6. Pre-existing medical conditions may reduce the settlement.
It would affect your accident compensation if you had prior injuries. You need to hire an experienced attorney who can develop the best strategy for presenting your claim and proving that your new injuries worsened the old ones. Having pre-existing conditions will most likely reduce your bus accident compensation. We have a separate article explaining how prior injuries affect your accident settlement.
7. You can get compensated for your injury only once.
Remember, you can get injury compensation only once, and the insurance company closes the case. After the insurance company settles your claim, your bus accident attorney can't go back and ask for more money, even if you need more medical treatment.
8. Las Vegas visitors can have treatment in their home state.
If you are a Las Vegas visitor and your bus accident happened in Las Vegas or somewhere in Nevada, the bus accident attorney licensed in Nevada must file a lawsuit on your behalf.
Our office handles many claims for clients who are NOT Las Vegas residents and who got in a bus accident while visiting Las Vegas or Nevada.
Usually, an accident victim receives medical treatment in their home city or state. We collect medical receipts and track the case's progress from inception to settlement from our office in Las Vegas. When we settle the case, we mail the settlement check to our clients.
9. Beware of social media.
Don't post the latest updates about your bus accident, the progress of your lawsuit, or what you plan to do with your settlement on social media. Today you are responsible for your posting and what your family members, friends, or co-workers post on social media.
Not only people in your inner circle read your posts. The insurance company adjuster reads it too. Even if you delete your posts on social media later, the insurance company can subpoena your social media accounts to access your deleted posts.
In addition, don't share your active lifestyle photos shortly after an accident or while receiving medical treatment with your friends, relatives, or co-workers. One of these photos will appear at the insurance adjuster's desk.
