About Allstate Insurance

Allstate is one of the largest auto insurance providers in Nevada. It also means that thousands of drivers file their auto accident claims against Allstate insurance every month. We compiled a list of our clients' most popular questions about the Allstate claims process.

Allstate cases: Who is liable?

In Nevada, a negligent driver (or their insurance carrier) is financially responsible for injuries and property damage caused by a car crash.

What is the demand for settlement?

A demand usually comes in a packet called a "Demand Packet" that includes a person's medical bills and records, lost wages, and a letter summarizing the person's pain and suffering and asking or demanding a specific amount of money. When an insurance company receives a demand packet, a legal duty is triggered to evaluate the claim within a specified amount of time. The insurance company must provide a timely response to the demand packet, even if the response is a request for more information.

How do you negotiate a car accident settlement with Allstate?

Adjusters get hired to "adjust" claims. It usually means that adjusters will devalue your request and try to pay you less than you deserve. Adjusters deploy a variety of tricks to devalue your claim. Beware of answering questions that can lessen your pain and suffering or the extent of your injuries. And watch out for adjusters who will string you along with hints that they will pay you soon and then ignore you once they have locked you in with answers that devalue your claim.

How long does it take to get a settlement check from Allstate?

Settlement checks can be overnighted, or they can take a few weeks to arrive. Sometimes, the insurance company will pay third parties out of the settlement and give you the remainder, and by doing it, they will delay the payment process.

Every case is unique in its facts and circumstances.

What happens if my car is totaled, and it's not my fault?

If your car is totaled, then it is a "total loss." It also means your vehicle is more expensive to fix than what the car is worth. The at-fault insurance will pay you a total loss amount based on their calculation of the total loss value. If you have full coverage, your insurance will pay you this value minus your deductible if you decide to use your insurance. Your deductible should be returned to you once your insurance gets reimbursed from the at-fault driver or their insurance.

How do I maximize my Allstate settlement?

A person can maximize their claim by including lost wages, recommendations for future treatment, and a detailed explanation of how their injuries have impacted them at work and home. Lost enjoyment and even anxiety from driving are also essential to add - if they are applicable.

Do I call my insurance if it's not my fault?

You must cooperate with your insurance based on the terms of the contract you signed with your insurance. If you decide to bring your insurance into the mix, expect a recorded statement and regular contact with an insurance company's adjuster to help them better assist you in resolving the claim.

This rule applies to any insurance company, not only Allstate insurance.

What should you not say to your insurance company after an accident?

You should never lie to your insurance company. Remember that the insurance company will record everything you say for future reference. A lie may be sufficient grounds for your insurance company to negate coverage. When this happens, you will lose the protection you have been paying for with your premiums.

Do I have to talk to the other driver's car insurance company after an accident?

You do not have to talk to an adverse driver’s insurance. It is always a good idea to seek legal advice and representation so that you do not mistakenly hurt yourself by what you say to the adverse insurance company. We invite you to call us at 702-432-1000 to discuss your case.

Do insurance companies talk to each other?

Insurance adjusters will routinely discuss accidents with each other to help them better understand the accident. No rule prohibits them from discussing your case with each other, even if they are from different insurance companies. Your accident will also be reported to a database that all insurance companies share. This information helps adjusters better understand the specific accident they are adjusting, and agents better understand the price of future insurance coverage.

How much should I settle a car accident case?

Every case is different, just like every person's circumstances are different. A healthy decision-making process looks at the risk and rewards trade-off of continuing to battle in court. As cases go through the court system, the costs of fighting the other side tend to rise. These costs include charges for experts, court fees, and the very high price of time spent. Also, as cases move through the court system, risks or opportunities may arise that can destroy evidence or save a lawsuit.

A strong understanding of the case's facts and a person's circumstances should lead to the right outcome.

Can I file a car insurance claim without a police report?

Yes, you can. A person files an insurance claim by contacting the insurance company and being assigned a claim number. At that point, the insurance creates a file for your claim, and an adjuster or team of adjusters is assigned. It is only the beginning of the process. The insurance company uses the claim number throughout the process to reference the claim itself.

Always have the insurance policy handy so the insurance company can quickly generate a claim number.

In the case of Allstate, how much can you sue for pain and suffering?

Pain and suffering are subjective. Some people have a lower pain tolerance than others, and an injury can interfere more with one person's daily routine than another's. In Nevada, there is no limit on how much a person can ask for pain and suffering in most cases. There are some exceptions.
