What to do when injured in a hotel accident in Las Vegas
We compiled a list of DOs and DONTs for those of you who were injured in a hotel accident during the pandemic. These rules apply to all hotel accidents, including slips and falls, elevator and escalator accidents, falls down the stairs, and accidents in the hotel parking lot.

The DOs
• DO get medical attention. If you had a slip and fall accident at the hotel, were robbed, assaulted, injured, or raped on the hotel grounds, if you had an elevator or escalator accident at the hotel, fell down the stairs at the hotel in Las Vegas, first and foremost - seek medical attention. Even if you feel you are probably okay, still see a medical professional.
• DO report the accident to the hotel management. You need to report the accident to the hotel management so they can contact their insurance company and file an incident report with the day, time, and description of what happened. If the case goes to court, the attorneys will use this incident report as evidence.
• DO take many photos of the hotel accident location. Take as many pictures as possible if there is a torn carpet or broken chair, stairwells, or steps. If you are injured and can't take photos, ask somebody to help. You will need it when you file an insurance claim.
• DO document the day, time, and location, the name of the hotel manager to whom you reported this hotel accident, and the name of every person you spoke with on that day. Record how long it took the ambulance to arrive. Document the doctor's name and what the doctor told you when you were at the hospital.
• DO save any physical evidence of an accident, especially clothing and shoes. Your clothing and shoes during the accident may be relevant in slip-and-fall hotel accident cases.
• DO be aware that the hotel will use video surveillance footage of the accident area to verify your statements and confirm the dangerous condition and for how long.
• DO take many pictures of your injuries. Within the next few days after the accident, document everything. Were you tired? Couldn't follow your daily routine? Couldn't work? How many days did you miss at work? Did you get paid for the time off? Did your employer pay you while you were in a hospital or recuperating after the injury?
• DO record the eyewitness's information. If you are injured and can't talk to eyewitnesses, ask somebody who accompanied you to record the eyewitness information.
• DO keep social distancing during pandemics and comply with all CDC recommendations.
• DO take safety precautions when going to a hospital. After visiting a hospital following your hotel accident, stay alert for possible exposure to COVID-19 for the next 14 days.
• DO know that it is not unusual for insurance companies to bring a private investigator who will record your daily activity after a hotel accident and use it as evidence during the trial.
• DO know that if your hotel accident occurred in Las Vegas or another Nevada city, the liability claim must originate in Nevada. You can continue receiving their medical treatment in your home city and state and get compensated for medical bills and other damages.
• DO keep track of all your out-of-pocket expenses, lost wages, and other costs associated with your injury.

THE DON'Ts
• DON'T reveal your personal or current financial situation to an insurance company when they call you. Doing so may raise questions about the extent of your injuries and undermine your credibility.
• DON'T tell the hotel insurance you are "okay" or "feeling okay" when they call you. It is not uncommon for the hotel's insurance to attempt to settle a claim with a victim directly. Be aware: you are on the recorded line when you speak with the hotel insurance. Later, they will use every word you say to deny or devalue your claim. It's best not to give the insurance company any information unless it is in a highly structured and controlled setting and with an attorney's aid.
• DON'T attempt to return to normal activities immediately after the hotel accident. People often don't feel their injuries are significant right after an accident. Neck and back injuries may surface days or even weeks later. Wait until your doctor releases you to work.
• DON'T post the latest status of your lawsuit or what you plan to do with your settlement money on social media. Not only do your friends read your posts, but the insurance company adjuster also reads them and will later compare what you tell your friends with what your injury attorney tells them. Even if you delete your posts on social media later, the insurance company can subpoena your social media accounts to access your deleted posts.
• DON'T share your active lifestyle photos with your friends, relatives, or co-workers shortly after an accident or while receiving medical treatment. One of these photos will appear on the insurance adjuster's desk.
• DON'T accept an insurance company's first injury settlement offer without first talking to an attorney and clearly understanding all your past and future medical expenses. You can settle your claim only once with any given insurance company. After you get injury compensation and cash your check, your attorney cannot submit an insurance claim again and ask for more reimbursement, even if you need more treatment.
