What is embezzlement?
The misappropriation of funds placed in one's trust or belonging to one's employer for his or her personal gain is called embezzlement. Stealing company information and selling it for money to another party who can financially benefit from that information is also an act of embezzlement.
NRS 205.300 states that any person or "bailee of any money, goods or property, who converts it to his or her use, with the intent to steal it or to defraud the owner or owners … is guilty of embezzlement." NRS Rules 205-300 thru 205-312 cover embezzlement charges.

Is embezzlement a felony?
It depends. In Nevada, embezzlement can be treated as either a felony or a misdemeanor, depending on the circumstances of the case and, sometimes, the accused person's criminal history.
Penalty for embezzlement
The penalty for embezzlement is connected to the value of the embezzled property.
If the embezzled property value is less than $650, the crime is considered a misdemeanor and is punishable by a maximum of 6 months in jail and a $1,000 fine.
If the value of the embezzled property is between $650 and $3,500, then the crime is considered a category C felony and is punishable by 1 to 5 years in a Nevada prison and a $10,000 fine.
If the embezzled property value is $3,500 or more, the crime is considered a category B felony, with a potential punishment of 1 to 10 years in prison and a $10,000 fine.
In some cases, the embezzlement charges could be dropped, and the case is dismissed altogether after the accused person returned the money.
Restitution
In criminal cases, one of the penalties imposed requires the return of stolen goods to the victim or paying the victim for harm caused. This is called restitution.
Can a business partner be charged with embezzlement?
Yes. If your business partner stole money or property from the company, you could claim to recover the items or funds.
What is the maximum punishment for embezzlement?
Under Nevada law, penalties for category C felony are between 1 and 20 years in prison and up to a $500,000 fine.
Is it embezzlement if the money is returned?
