Amazon Flex: What to know

Amazon Flex drivers work as independent contractors who use an Amazon Flex technology platform to deliver packages.

This program's participants are usually part-timers who use their vehicles to make deliveries.

The packages delivered via Amazon Flex can include various items, such as books, electronics, household items, groceries, etc. The size and weight of the boxes vary, but they are typically small enough to be delivered using a personal vehicle.

The drivers receive delivery offers via a smartphone app, reserve different delivery blocks - times they are available to deliver packages and navigate via the app to the destination.

The pay depends on how many packages the driver delivers. So, the drivers are motivated to drive fast, and while doing it, they sometimes become reckless and negligent. Speeding, tailgating, and driver fatigue are the most common reasons for delivery drivers' accidents.

How Amazon Flex drivers' insurance works

Amazon Flex provides insurance coverage for its drivers only while on a delivery trip.

At the time of writing, the maximum insurance coverage for Amazon Flex drivers was $1 million per accident, subject to a $1,000 deductible, $50,000 in damages to your vehicle, and includes 1 million uninsured/underinsured coverage.

Amazon Flex also provides contingent comprehensive and collision insurance coverage. It covers physical damage to the driver's vehicle resulting from a non-collision event (e.g., fire, vandalism, a natural disaster, etc.)

However, Amazon Flex insurance is supplementary to a delivery driver's auto insurance policy and does not replace it.

Amazon Flex delivery drivers are responsible for maintaining their auto insurance and must have a minimum of comprehensive collision coverage with $50,000 in damages to the vehicle.

Another thing to remember: Amazon Flex commercial insurance doesn't cover passengers or driver substitutes.

Who is liable?

In Nevada, a negligent driver (or their insurance carrier) is financially responsible for injuries and property damage caused by a car accident.

Injury compensation

If the driver was on a "Job" delivering packages for Amazon and got in an accident, then the Amazon Flex commercial insurance is in effect.

If the driver uses the car for personal trips and gets in an accident, the car insurance will cover the losses up to the driver's insurance policy limit.

Amazon Flex commercial insurance doesn't cover passengers. The same is true if the driver asks somebody to deliver packages.

Do I need an attorney?

An attorney is not required, but if you got injured in an accident, ended up in a hospital, and missed work, you may need an attorney to get full and fair accident compensation. Especially when your injuries require long-term care, you need help from an attorney to calculate your future expenses.

What settlement to expect?

Your settlement is calculated based on your medical bill (past, present, future), diminished earning capacity, damaged property (usually your vehicle), and other damages.

Each case is different. If you got injured in an accident involving an Amazon Flex delivery driver and want to know what compensation to expect, call our office at 702-432-1000 and ask to speak with an attorney who handles Amazon Flex accidents.

Accidents with multiple victims

Like most car accidents, when an Amazon Flex accident involves numerous victims, each person files a separate accident liability claim against the Amazon Flex driver and the Amazon Flex commercial insurance.

Multiple vehicle accidents

Accidents involving multiple vehicles could be complex - the challenge of multi-vehicle accidents is to establish fault and often to establish a percentage of fault. In addition, multi-vehicle accidents can take longer to settle because more than one victim is usually involved, and you have to deal with more than one insurance company.

However, whether there are numerous vehicles or just one vehicle involved in an Amazon Flex car accident in Las Vegas or Nevada, it makes no difference in the compensation you are entitled to.

Suppose your car collision resulted in a severe injury. In that case, if the Amazon Flex car driver was involved, you should be compensated for your medical bills, lost wages, damaged property, and pain and suffering.

How long should I wait for a settlement from Amazon Flex?

In some cases, the attorneys could settle your claim within a few months, while in others, it may be a few years. It depends on the case's complexity, the evidence's availability, and all parties' willingness to settle.

When foreigners get injured in an accident in Las Vegas or Nevada

It may not be simple if a person injured in an Amazon Flex driver accident is a foreign national.

If an accident victim ends up in a Las Vegas hospital and receives medical treatment for injuries in the US, the liability claim will be based on the US hospital bills. Getting compensation for medical treatment in another country could be more complex because a) the overall cost of medical care can be different, and b) medical treatment and procedures recommended in other countries may not get approved in the US.

If you got injured in an accident involving an Amazon Flex vehicle in Las Vegas or Nevada, call us at 702-432-1000 and ask to speak with a personal injury attorney.
