Amazon Flex: What to know

Amazon Flex drivers work as independent contractors who use an Amazon Flex technology platform to deliver packages.

The participants in this program are typically part-time workers who use their own vehicles for deliveries.

The packages delivered via Amazon Flex can include a variety of items, such as books, electronics, household goods, and groceries. The size and weight of the boxes vary, but they are typically small enough to be delivered using a personal vehicle.

The drivers receive delivery offers via a smartphone app, reserve specific delivery blocks (i.e., the times they are available to deliver packages), and use the app to navigate to the destination.

The pay depends on the number of packages the driver delivers. So, the drivers are motivated to drive fast, and while doing it, they sometimes become reckless and negligent. Speeding, tailgating, and driver fatigue are the most common causes of accidents involving delivery drivers.

How Amazon Flex drivers' insurance works

a) Amazon provides up to $1 million in commercial auto liability coverage for drivers actively delivering packages. However, this coverage does not apply when the driver is off duty or using the vehicle for personal reasons.

b) Amazon Flex delivery drivers are responsible for maintaining their auto insurance and must have a minimum of comprehensive collision coverage with $50,000 in damages to the vehicle. Amazon Flex insurance is supplementary to a delivery driver's auto insurance policy and does not replace it.

Another thing to remember: Amazon Flex commercial insurance doesn't cover passengers or driver substitutes.

Who pays for your injuries after an Amazon Flex accident in Las Vegas? Amazon Flex claims

We hear this question often. The answer depends on whether the driver was working for Amazon Flex at the time of the crash.

If the driver makes deliveries or picks up packages and causes an accident, Amazon's commercial auto liability policy typically covers the accident — up to $1 million per crash. It includes paying for your medical expenses (past, present, and future), lost wages or diminished earning capacity, property damage, and pain and suffering.

If the driver had finished deliveries or was using the vehicle for personal reasons, Amazon's insurance does not apply. In that case, you would file a claim under the driver's personal auto-insurance policy.

If an Amazon Flex driver hit you in Las Vegas or anywhere in Nevada, don't try to deal with Amazon or the insurance company on your own. Contact us for a free consultation. We'll review your case and determine whether Amazon or the driver's policy is responsible for your injuries.

Does Amazon Flex insurance cover passengers?

No. Amazon Flex's commercial insurance does not cover passengers. Coverage applies only to the driver and authorized deliveries made through the Amazon Flex app. If a driver allows another person to ride along or help with deliveries, that person is not covered under Amazon's policy.

Do I need an attorney?

An attorney is not required, but if you were injured in an accident, ended up in a hospital, and missed work, you may need an attorney to get full and fair accident compensation. Especially when your injuries require long-term care, you need help from an attorney to calculate your future expenses.

What settlement to expect?

Your settlement is calculated based on your medical bill (past, present, future), diminished earning capacity, damaged property (usually your vehicle), and other damages.

Each case is different. If you got injured in an accident involving an Amazon Flex delivery driver and want to know what compensation to expect, call our office at 702-432-1000 and ask to speak with an attorney who handles Amazon Flex accidents.

Accidents with multiple victims

Like most car accidents, when an Amazon Flex accident involves multiple victims, each person files a separate claim for accident liability against the Amazon Flex driver and the Amazon Flex commercial insurance.

Multiple vehicle accidents

Accidents involving multiple vehicles can be complex. The challenge of multi-vehicle accidents is to establish fault and often to determine a percentage of fault. In addition, multi-vehicle accidents can take longer to settle because more than one victim is usually involved, and you have to deal with more than one insurance company.

However, whether there are numerous vehicles or just one vehicle involved in an Amazon Flex car accident in Las Vegas or Nevada, there is no difference in the compensation you are entitled to.

Suppose your car collision resulted in a severe injury. In that case, if the Amazon Flex car driver was involved, you should be compensated for your medical bills, lost wages, damaged property, and pain and suffering.

How long should I wait for a settlement from Amazon Flex?

In some cases, the attorneys could settle your claim within a few months; in others, it may be a few years. It depends on the case's complexity, the availability of evidence, and the willingness of all parties to settle.

Time limits to file an Amazon Flex accident claim in Las Vegas

Under Nevada law, typically, you have two (2) years from the incident date to file your injury compensation claim. All Amazon Flex accidents fall into this category.

When foreigners get injured in an accident in Las Vegas or Nevada

It may not be simple if a person injured in an Amazon Flex driver accident is a foreign national.

If an accident victim ends up in a Las Vegas hospital and receives medical treatment for injuries in the US, the liability claim will be based on the US hospital bills. Getting compensation for medical treatment in another country could be more complex because a) the overall cost of medical care can be different, and b) medical treatment and procedures recommended in other countries may not be approved in the US.

If you got injured in an Amazon Flex vehicle accident in Las Vegas or Nevada, call us at 702-432-1000 and ask to speak with a personal injury attorney.

Can I sue Amazon if the driver damages or destroys my package?

You can sue, but winning may be difficult. Amazon usually denies liability once a package is marked "delivered." Contact Amazon first — in most cases, they'll refund or replace the damaged item. Suing the driver is rarely practical since their personal information isn't disclosed.

Do I need to provide the Amazon driver with my gate code?

No. You're not required to give your gate code to an Amazon driver. If you're uncomfortable sharing your code, you can use either Amazon Locker or provide "Leave at the Gate" instructions to the driver.

If the Amazon driver destroyed my front yard or mailbox, can I sue Amazon?

Yes, but it depends on who the driver works for.

If the driver is an Amazon employee, file a property damage claim directly with Amazon.

If the driver is an Amazon Flex contractor, Amazon provides up to $1 million in commercial auto liability coverage for accidents during active deliveries. Report the damage through Amazon Customer Service or file a claim under that policy. You don't need an attorney for that.
