What is an airbag injury?
An airbag injury refers to any harm or damage caused by the deployment of a vehicle's airbag during a crash or sudden impact.
What is the cause of airbag injuries?
Airbag injuries can occur due to several factors, including how the airbag is designed, installed, or deployed during a crash.
In some cases, manufacturer defects—such as issues with the airbag's design or production—are to blame for accidents and injuries. However, based on our experience, most car accidents, including those involving airbags, are caused by negligence by a driver, manufacturer, or another party.
Common airbag injuries
The injuries after the airbag accident may include:
• Burns to the face, arms, and hands. These injuries happen when the airbag explodes out and is very hot. The burns often require plastic surgery.
• Broken nose injuries. A fractured nose injury can impact breathing and have a long-term effect on a victim.
• Concussions and black eyes. Anytime an airbag goes off, there is a concussion, and the black eyes are a strong symptom. The victim must see a neurologist to determine the injury's severity and if long-term treatment is required.
.Who is liable for an airbag injury?
Below is not an all-inclusive list of negligent parties responsible for the airbag accident:
- Airbag designer,
- Airbag manufacturer,
- Airbag installer,
- Vehicle manufacturer,
- Vehicle repair shop,
- At-fault driver.
Under Nevada law, the negligent party is financially liable for all damages - medical bills, lost wages, property damages, and pain and suffering.
In some cases, more than one entity could be responsible for the airbag accident.
"Strict liability" in airbag injury claims
If a defective product caused the airbag injury, the rules of 'strict liability' apply. This means that the victim (or their attorney) only needs to prove two things: first, that the injury resulted from a defect in the product, and second, the extent of the damages. There is no need to prove that the defendant acted negligently or was at fault.
Airbag injury: What to do
If you believe that a defective airbag caused your injuries, it is crucial to preserve all evidence: your airbag, the crash sensor, and anything else airbag-related to your car crash. Sufficient proof from your car's computer can be critical in establishing a fault. Keep your vehicle even if the insurer declares it a total loss.
Class-action lawsuits and airbag injury liability claims
Some airbag injury cases result in a class-action lawsuit. One example would be when defective airbags caused injuries to many people, like in a class-action lawsuit against Japanese airbag supplier Takata Corporation and several car makers that used Takata airbags. Another example would be when a single incident leads to injuries to many people.
Airbag injury compensation
In Nevada, the party responsible for a motor vehicle accident (or their business insurance) is financially liable for all damages.
The accident compensation includes:
- Medical bills (past, present, future),
- Lost wages,
- Property damages,
- Pain and suffering,
- PTSD (Post Traumatic Stress Disorder),
- Loss of enjoyment of life.
If you were partly at fault
Nevada uses the rule of modified comparative negligence. The plaintiff could collect compensation from all other at-fault parties if the plaintiff were less than 51% responsible for the accident. So, if you suffered an airbag injury and were partly at fault, you still could be eligible for accident compensation, but the amount will be smaller.
