Time limits to file an injury claim in Nevada

In Las Vegas and Nevada, the statute of limitations to all injury claims expires two (2) from the accident date. It includes all head injury claims.

If you were partly at fault

In Nevada, head injury accident victims can seek compensation even if they were partially at fault. The legal term for this is a modified comparative negligence state, which means to you - if you were less than 51% at fault, you are still entitled to compensation.

How much compensation do you get for a head injury?

It depends on how severe the injury is. Doctors classified head injuries as mild, moderate, or severe. The settlement for a mild injury will be very different from a severe head injury. Proving a head injury

The challenges that attorneys face are that the effect of a head injury is sometimes not shown immediately after the accident. The person may look and act normal, the damage could be invisible, and only an MRI or CT scan can prove a head injury.

What makes head injury cases more challenging is that you can settle an injury case only once, then the case is closed. Even if the victim requires more medical treatment later, the attorney can't submit a claim for the same accident the second time. We always advise our clients to continue with medical treatment until the doctor officially releases them.
